Grievances
Grievance handling
Both sides keep their own file of the same events. Termsroom holds one that belongs to both, with a sealed room for each party beside it.
Each party works in a room nobody else can see into, including us, and can open a sub-room for counsel or an adviser brought in on one matter who sees that matter and nothing else. Anything moved to the shared record is recorded as it moves, with the date on it, and neither side can change it afterwards. Documents stay in the storage your own organisation already owns: the record holds where a document is and what its fingerprint is, never the document.
How a grievance runs in Termsroom
A grievance sits beside the negotiation between the same two parties, with the same sealed rooms and the same shared record. Both sides see the same case, the same events and the same clock.
- 1
Set the steps from your agreement
Step structures differ between collective agreements, so they are configured rather than assumed: a name for each step, the days each side has to respond and to advance, counted in working or calendar days.
- 2
File and serve
An individual, group or policy grievance is filed with a reference, the articles relied on and the remedy sought. The grievor is identified by an employee number or initials rather than a name, and the official language the grievor chose is recorded on the case.
- 3
Respond and advance
Responses, meetings and advances are recorded as they happen. A grievance advances once the other side has answered, or once the time it had to answer has run out.
- 4
Let the clock do the arithmetic
Every due date is calculated from the steps and the recorded acts at the moment you look, never typed in. Each side sees what it owes and by when.
- 5
Extend only by agreement
Either side can propose more days. The extension counts only when the other side agrees, and the clock moves with it.
- 6
Close it
Settled, withdrawn, abandoned or referred to arbitration, with the date and every recorded act behind it.
Worth knowing
- Not built yet: agreed facts, each side’s contentions, a settlement channel and an arbitration bundle. They carry the privilege questions counsel tests first, so they are being built separately.
- Statutory holidays are not applied to working days, because they vary by jurisdiction. Where your agreement depends on them, count that step in calendar days.
- The record holds what each side did. It never records who opened or read anything.
Grievances are part of the annual plans. They are not included in a single deal.
